Eviction Moratorium (City Order)
Does the moratorium mean I don’t owe rent?
No. This is not rent forgiveness. If you can pay, keep paying to avoid building a large balance that will still be due later.
Does the moratorium mean I can skip rent now and catch up later?
If you can pay, keep paying. The balance will still be due, and large past-due amounts can create hardship once protections end.
What housing is covered?
City-owned, sponsored, funded units and developments, including those connected to Atlanta Housing, Invest Atlanta, Partners for HOME, Fulton/City Land Bank, Atlanta BeltLine Inc., and the City’s Department of Grants & Community Development. If you’re unsure whether your home is covered, contact Atlanta Housing (see “Help” below).
Which Atlanta Housing Properties are covered by the moratorium?
Under the ATL CARES order, all City-owned, City-sponsored, and City-funded housing developments are subject to the temporary moratorium on evictions and late fees through January 31, 2026, or until the federal shutdown ends. This includes every Atlanta Housing–assisted unit, both project-based and tenant-based, within the City of Atlanta.
Full listings of multifamily complexes with project-based AH-assisted units as of Friday, November 7, are available on our website. While the moratorium also includes tenant-based vouchers, those addresses cannot be published for privacy reasons.
What exactly is paused?
For covered properties:
- Issuing termination notices for non-payment
- Filing or proceeding with evictions for non-payment
- Assessing late fees/charges tied to late or non-payment
How long does the moratorium last?
Through January 31, 2026, or until the federal shutdown ends—whichever happens first.
What if my income changed (furlough, layoff, reduced hours)?
Report a hardship claim to Atlanta Housing. Contact your Atlanta Housing case manager or your property manager to start a hardship review. You may be asked for documentation so we can evaluate your situation under Atlanta Housing policy.
I received a notice from my landlord. What should I do?
Call Atlanta Housing. We’ll help you determine if your home is covered by the City’s order and what your options are. Keep all paperwork.
Are other lease violations covered?
The moratorium targets non-payment. Other health, safety or lease violations may still be enforced.
What about utilities?
The City’s Department of Watershed Management will not terminate residential water service for non-payment during the same period. Other utilities are separate. Please contact your provider directly.
I saw a message from Georgia Department of Community Affairs about partial payments, does that affect me?
Atlanta Housing is separate from Georgia Department of Community Affairs. At this time, Atlanta Housing continues making full HAP payments.
